INDENTURE between Henry Sturt and Thomas May (and Samuel Morley) re Little Lucy’s Farm, Tonbridge: 16 September 1886

MEMORANDUM AND AGREEMENT

Made the sixteenth day of September one thousand eight hundred and eighty six between THOMAS MAY of Leigh in the county of Kent Clerk in Holy Orders of the one part and HENRY STURT of Hildenborough in the said County of Kent Tanner of the other part. WHEREAS by Indenture of Lease bearing date the thirteenth day of May one thousand eight hundred and seventy four and made between the said THOMAS MAY of the one part of SAMUEL MORLEY of Hall Place in the said County of Kent of the other part. All that messuage or tenement farm and premises known by the name of LITTLE LUCY’S FARM containing thirty three acres one rood and twenty perches little more or less situate and being in the Parish of Tonbridge in the said County of Kent which said premises were more particularly delineated and described in the map or plan endorsed on the now reciting Indenture and in the Schedule thereto together with all and singular the appurtenances to the hereby demised premises were demised by the said THOMAS MAY to the said SAMUEL MORLEY for the term of thirteen years from the twenty ninth day of September one thousand and eight hundred and seventy three at the yearly rent of Fifty pounds subject to the Lessees Covenants therein contained AND whereas by Indenture of Underlease bearing date the seventy day of February one thousand eight hundred ad eighty three between the said SAMUEL MORLEY (with the consent of the said THOMAS MAY) of the one part and the said HENRY STURT of the other part the said SAMUEL MORLEY demised to the said HENRY STURT his executers administrators and assigns all the said messuage tenement farm and premises called LITTLE LUCY’S FARM under payment of the yearly rent of Fifty pounds and subject to the performance of all the Covenants and conditions contained in the said Indenture of Lease of the thirteen day of May One thousand eight hundred and seventy four and on the Lessees part to be observed and performed AND whereas the said HENRY STURT has agreed with the said THOMAS MAY to continue the occupation of the said farm and premises as yearly tenant from the twenty ninth day of September one thousand eight hundred and eighty six at the yearly rent of forty pound and upon conditions in all respects similar to the conditions in the said herein before recited Indentures of lease contained except as hereby altered or modified NOW it is hereby mutually agreed by and between the parties such as follows:

1. THE said THOMAS MAY agrees to let and the said HENRY STURT agrees to take ALL that messuage or tenement farm and premises known by the name of LITTLE LUCY’S FARM containing thirty three acres one rood and twenty perches little more or less situate and being in the Parish of Tunbridge in the said County of Kent which said premises are more particularly delineated and described in the map or plan endorsed on the said Indenture of the seventh day of February one thousand eight hundred and eighty three and in the schedule thereto together with all and singular the appurtenances but excepting and reserving to the said Thomas MAY the exclusive rights of shooting and fishing over the said premises the tenancy to be form year to year commencing on the twenty ninth day of September one thousand eight hundred and eighty six and determinable at the end of any year by a years notice to quit given by either party to the other and subject to the conditions herein expressed.

2. The said HENRY STURT shall pay to the said THOMAS MAY the yearly rent of Forty pounds by equal half yearly payments on the sixth day of April and the twenty ninth day of September in every year the first of such payments to be made on the sixth day of April next.

3. The said HENRY STURT shall at all times observe and perform all the Covenants and conditions contained in the hereinbefore recited Indenture of Lease of the thirteenth day of May one thousand eight hundred and seventy four and the Indenture of Underlease of the seventh day of February one thousand eight hundred and eighty three and on the Lessees part to be observed and performed.

4. If the said yearly rent of Forty pounds or any part thereof shall be in arrears for the space of twenty one days next after any of the days wherein the same ought to be paid as aforesaid whether the same shall or shall not have been legally demanded or if there shall be any breach or non observance of the Covenants by the said HENRY STURT then and in any of such cases it shall be lawful for the said THOMAS MAY at any time thereafter into and upon the said premises or any part thereof in the name of the whole to re..ler
