Deed 1 August 1913 Exchange of Land and Cottages (South View/corner Green Lane)

Transcription below of DEED IN RESPECT OF   EXCHANGE OF LAND AND COTTAGES BETWEEN TRUSTEES OF LEIGH UNITED CHARITIES AND SAMUEL HOPE BARON HOLLENDEN :

CONDITION OF DEED AND MAP:

Poor condition; has been exposed to damp; very difficult to read – the pure repetition in these deeds has helped in transcription – the map is stuck to the deed and cannot be prised apart.  However, can see where the red coloured and green coloured portions of the map to which this deed relates.

Dated 1913, the details relate to the straight exchange of the land which now forms part of the garden at South View where there were 3 cottages held by the Trustees of Leigh Charities to Lord Hollenden  for two cottages on the south side of the Green, on the corner of Green Lane  (where Cherry Tree cottages are today), then owned by Lord Hollenden and now given to Leigh United Charities.

Samuel Hope Morley had the 3 cottages in the ‘garden’ at South View pulled down to make a garden at the entrance to the village (see Lawrence Biddle p. 133).    At some point this garden became incorporated into the gardens at South View.   Hall Place Estate sold South View and its surrounding gardens in the 1950s.

TRANSCRIPTION OF DEED DATED 1 AUGUST 1913

WHEREAS the Trustees of the United Charities of Leigh in the County of Kent the persons /
Interested under the provisions of the Indentures Acts of 184.. and 1899 in the lands and hereditaments specified in the /
following schedule hereunder within ……….parish Leigh in the said county of Kent and the Right /
Honourable Samuel Hope Baron Hollenden the person interested under the provisions of the said Acts /
In the lands and hereditaments specified ……. Schedule hereunder written also situate in the said /
Parish of Leigh being desired  of effects ……… exchange of the same lands and hereditaments made due /
Application to the Board of Agriculture and Fisheries to present  Inquiries respecting and to proceed with the same /
under the provisions of the said Acts.
AND whereas due note by   advertisement in two successive weeks of the said proposed exchange  has /
been given and one Calendar month has elapsed from the publication of the last of such advertisements and /
no notice of dissent from such proposed exchange has been given and the Board of Agriculture and /
Fisheries having duly  made  ….  share of opinion ….  exchange would be beneficial to the Owners /
of such respective land and hereditaments and that the terms thereof are just and reasonable.

Acts shall  …………………………………………………………………..   declared that the lands and /
……………   specified and the hereditaments hereunder written and shown on the plan hereunto annexed /
With the rights easements and appurtenances thereto belonging shall be given by the said Trustees and taken /
By the said Baron Hollenden in exchange for the lands and hereditaments specified in the Second Schedule /
Hereunder written and also shewn on the said plan.
And that the said land and hereditaments specified in the Said Second schedule and shewn on the /
said plan with the rights easements and appurtenances thereto belonging shall be given by the said Baron /
Hollenden and taken by the said Trustees in exchange for the said lands and hereditaments  specified /
in the said first schedule and shewn on the said plan as aforesaid.
