LAW OF PROPERTY ACT 1925

CERTIFICATE OF AMOUNT OF REDEMPTION MONEY

WHEREAS a requisition has been duly made to the Minister of Agriculture and Fisheries pursuant to the provisions of Section 191 of the Law of Property Act, 1925, by The Right Honourable Geoffrey Hope Baron Hollenden of Hall Place Leigh in the County of Kent the owner of certain lands described in the Schedule hereto to certify the amount of money in consideration whereof the annual rent of three pounds ten shillings stated to be issuing out of the said lands may be redeemed;

NOW the Minister of Agriculture and Fisheries in pursuance of the powers vested in him by the Ministry of Agriculture and Fisheries Acts, 1889 to 1919, and the Law of Property Act 1925 does hereby certify that the amount of money in consideration whereof the said annual rent of three pounds ten shillings may at any time within one calendar month from the date hereof be redeemed is the sum of one hundred and two pounds fifteen shillings and sixpence together with all arrears and the apportioned part, if any, of the said annual rent up to the date of the payment or tender of the said sum of one hundred and two pounds, fifteen shillings and sixpence.

IN WITNESS whereof the Official Seal of the Minister of Agriculture and Fisheries is hereunto affixed this fifteenth day of June nineteen hundred and thirty eight.

We the Undersigned Trustees of the Leigh United Charities hereby acknowledge receipt from the Right Honourable Geoffrey Hope Baron Hollenden of Hall Place Leigh in the Country of Kent of the sum of One hundred and two pounds fifteen shillings and sixpence being the consideration money for the redemption of the annual rent of Three pounds ten shillings mentioned in the within Certificate, and the sum of One Pounds eight shillings and threepence the apportioned part of the rent payable up to the date hereof, and we certify that there are no arrears of the rent outstanding.

THE MINISTER OF AGRICULTURE AND FISHERIES in pursuance of the powers vested in him by the Ministry of Agriculture and Fisheries Act 1889 to 1919 and the Law of Property Act 1925 does hereby certify that the within mentioned annual rent of three pounds ten shillings has been redeemed by the payment on the twenty ninth day of June 1938 to the Trustees of the Charity known as the Leigh United Charities who by virtue of an order of the Charity Commissioners dated the ninth day of September 1938 are the persons employed to dispose of the said annual rent absolutely or to give an absolute discharge of the capital value thereof of the sum of one hundred and two pounds fifteen shillings and sixpence being the sum certified by the Minister of Agriculture and Fisheries as the sum of money in consideration whereof the said annual rent might be redeemed together with all arrears and the apportioned part of the said annual rent up to the date of payment of the said sum of one hundred and two pounds fifteen shillings and sixpence.

IN WITNESS whereof the Official Sea of the Minister of Agriculture and Fisheries is hereunto affixed this twenty seventh day of September nineteen hundred and thirty eight.

MINISTRY OF AGRICULTURE AND FISHERIES
CERTIFICATE OF APPORTIONMENT OF RENT UNDER
SECTION 191 (7) of the law of property act 1925

WHEREAS the Right Honourable Geoffrey Hope Baron Hollenden of Hall Place, Leigh and John Mackney, The Limes Farm Hildenborough, both in the County of Kent are persons interested according to the provisions of Section 191 of the law of Property Ac 1925 in the land described in Part One of the Schedule hereto, being part of the land situate in the parish of Leigh and Hildenborough in the said County described in Part One of the Schedule hereto, being part payable to the Trustees of Leigh United Charities; and affected by an annual rent of ten pounds ten shillings payable to the Trustees of the Leigh United Charities;

AND WHEREAS the said landowners desire to effect a discharge of the said land described in Part One of the Schedule hereto from the said rent.

AND WHEREAS the remainder of the said land affected by the said rent described in Part Two of the Schedule hereto is not exonerated or indemnified from the rent by means of a charge on the said land described in part One of the Schedule hereto.

AND WHEREAS the said landowners have made application to the Minister of Agriculture and Fisheries to apportion by a Certificate in pursuance’s of the said Section such rent between the lands described in Parts One and Two respectively of the Schedule hereto.

NOW THEREFORE The Minister of Agriculture and Fisheries in pursuance of the powers vested in him by the Ministry of Agriculture and Fisheries Acts, 1889 – 1919 and the said Law of Property Act 1925 hereby certifies the apportionment of the said rent in the manner and proportions appearing in the Schedule hereto to the end that the sum so apportioned on the land comprised in Part One of the said Schedule shall be redeemable under he said Section and that on such redemption the said land comprised in Part One of the said Schedule shall be redeemable under the said Section and that on such redemption the said Land comprised in Part One of the said Schedule shall be discharged for the entire rent.

ATTACHED to document is a map of parishes of HILDENBOROUGH AND LEIGH (1938)

Red edged land:   is land along Mill Lane
Orange land: land along Mill Lane and along London Road (to north of ‘windmill’) past Old Cock Inn
Land in yellow:  two fields behind Oakhurst Wood and Cock Wood centrally between Mill Lane and London Road
Land in Purple:  land north and south of Lower Street: on one side Lower Street Farm area; on other side towards Tips Cross along Philpott Lane area,running opposite Lower Street farm, and small piece along Philpotts north.
Land in brown: south of Bid Bridge – Hildenborough Road into Leigh:  running from Shoulder of Mutton, Bid Bridge, including ‘the Allders’, to Kennards Farm past Home Farm, but excl. Leigh Cottage (the Woods) – so assume what was known as Parsonage Farm (formerly of Thomas May).
